Information regarding the notification procedure according to § 6 clause 4 of the 1st Ordinance to the Explosives Act (1. SprengV)

According to the decision of the European Court of Justice (ECJ), on October 27th 2016, within the infringement procedure for the implementation of the Directive 2007/23/EC on the placing on the market of pyrotechnic articles it was stated that the procedure regarding the notification according to § 6 clause 4 of the 1st Ordinance to the Explosives Act 1. SprengV) is inconsistent with the Directive 2007/23/EC.

On instruction by the Federal Ministry of the Interior (BMI), the Bundesanstalt für Materialforschung und -prüfung (BAM) will suspend the execution of the aforementioned procedure with effect from November 10th 2016; all ongoing notification procedures will be stopped and not be concluded according to § 6 clause 4 of the 1st Ordinance to the Explosives Act concerning pyrotechnical articles as defined by the pyrotechnical Directive.

From this day on new notifications according to § 6 clause 4 of the 1st Ordinance to the Explosives Act (1. SprengV) concerning pyrotechnical articles as defined by the pyrotechnical Directive will not be accepted.
